Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act.
From the possession of the petitioner, a loaded country made pistol was recovered besides the cartridges. Petitioner is in custody since 23.12.2016.
In the past, prayer for bail was refused vide Annexure-1 considering the criminal antecedent of the petitioner of similar nature. However, the learned trial court was directed to conclude the trial within one year.
The report of the trial Judge dated 26.05.2018 reveals that trial has not concluded as yet.
Patna High Court Cr.Misc. No.30366 of 2018 (3) dt.20-06-2018 2/2 Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chandradip Police Station Case No. 121 of 2016, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
