ANJANA MISHRA ORAL ORDER 26-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Purushottampur P.S.Case No.05 of 2015 for the offences under Sections 363, 366 and 34 of the I.P.C.

The case diary of the present case was called for which has since been received.

Learned counsel for the petitioner submits that though there is allegation against the petitioner that one Saddam Baitha had participated in kidnapping of the victim girl there is no cogent material against him.

Learned counsel for the State after perusal of the case diary submits that apparently the petitioner had participated

Patna High Court Cr.Misc. No.29619 of 2015 (5) dt.27-11-2015 2/2 in the kidnapping of the victim girl and after kidnapping he had handed her over to the said Saddam Baitha after which he had taken her to Gujrat.The victim girl in her statement recorded under Section 164 Cr.P.C. has explicitly implicated this petitioner. In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. It is, accordingly, rejected.
