The petitioner apprehends his arrest in connection with Kankarbagh P.S. Case No. 30 of 2014 registered for the offences punishable under Sections 406, 420, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the main allegation of borrowing the motorcycle is against Chhotu Kumar and not against this petitioner. It is further submitted that the petitioner is a student of A.N. College and friend of the said Chhotu Kumar and that is why, petitioner's name has been figured in the present case. It is further submitted that being the student without any criminal antecedent, he is not likely to abscond and he shall cooperate with the investigation making himself available before the police as and when

Considering the aforesaid submissions made by the petitioner, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Kankarbagh P.S. Case No. 30 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.

However, it is made clear that if the petitioner does not cooperate with the investigation of the case and absent himself from the trial, it will be open for the Court below to take appropriate steps in accordance with law.
