JUSTICE PARTHA SARTHY ORAL ORDER 03-03-2021 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Sarairanjan P.S. Case no. 39 of 2018 registered under sections 395, 397 and 412 of the Indian Penal Code.
The allegation in the FIR is of theft of idols of Lord Rama and Janki from the temple.
It is submitted by the learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Shahnawaz @ Nehal made before the police and the said Shahnawaz has been enlarged on bail vide order dated 30.07.2018 passed in Cr. Misc. no. 45579 of 2018. It is

No.40853 of 2020(3) dt.03-03-2021 2/2 submitted that the petitioner is in custody since 25.3.2020 and investigation in the case has concluded with submission of the charge-sheet. The petitioner has no criminal antecedent. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 25.3.2020, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sarairanjan P.S. Case no. 39 of 2018 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Samastipur.
