The petitioner apprehends his arrest in Ramgarh P.S. Case No.27 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that nothing has been recovered from possession of the petitioner. The name of the petitioner has surfaced in this case only on the basis of confessional statement of co-accused Pankaj Kumar Yadav.

The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his

No.50464 of 2021(2) dt.11-04-2022 2/2 arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Additional Sessions Judge-2-cum-Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No.103 of 2021 arising out of Ramgarh P.S. Case No.27 of 2021, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
