JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 22 ( C ) N.D.P.S. Act and 27 (D) (II), 28, 20B, 36 AC Drug and Cosmetic Act, 1945.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.07.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. He has no concern with the shop nor article which was seized from the shop. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.44411 of 2016 (2) dt.19-10-2016 2/2 the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Spl. Judge-cum- Sessions Judge, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S.Case No. 350 of 2016. (Sudhir Singh, J) singh/- U T
