JUSTICE RAKESH KUMAR ORAL ORDER 19-10-2016 Heard Dr. Leelawati Kumari, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is one of the named accused in Madanpur P.S. Case No. 232 of 2009 registered for the offence under Section 147, 149, 353, 307, 379, 427 of Indian Penal Code , Section 3⁄4 of the Explosive Substance Act , Section 27 of the Arms Act and Section 17 of the C.L.A. Act has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that many of the other accused persons having similar accusation have already been granted bail.

No.43041 of 2016 (2) dt.19-10-2016 2/2 However considering the nature of accusation as well as the fact that petitioner is named as one of the accused for serious offences and there is allegation that he is a member of naxalite , I am not inclined to extend the privilege of bail. The petition stands rejected.
