JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Warisaliganj P.S. Case No. 14 of 2017 for an offence under sections 420, 467, 471 and 120(B) of the Indian Penal Code. The petitioner is in custody since 6.2.2017.

In para-3 there is specific statement on affidavit that the petitioner has no criminal antecedent.

Counsel for the petitioner submits that similarly circumstanced co-accused have been granted bail by this court in Cr. Misc. No. 24509 of 2017 vide order dated 5.7.2017 and in Cr. Misc. No. 24210 of 2017 vide order dated 30.6.2017. The case of the petitioner appears to be similar to those co-accused who have been granted bail vide order dated 5.7.2017 and 30.6.2017 as mentioned above and as such the

No.28727 of 2017 (3) dt.20-07-2017 2/2 petitioner deserves bail on the ground of parity, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Nawada, in connection with Warisaliganj P.S. Case No. 14 of 2017 on the condition that one of the bailors should be close relatives of the petitioner. It goes without saying that the petitioner will cooperate in the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
