The petitioners seek bail in a case registered under Sections 420, 467, 468, 401, 413, 411, 120b of the Indian Penal Code.

Allegedly, the petitioners were involved in the crime of cheating, forging the documents and was involved in the crime of dealing with stolen property.

It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 18-04-2019. The petitioners have been made accused in the present case due

Patna High Court CR. MISC. No.38922 of 2019(2) dt.26-06-2019 2/2 to mistake of fact. A case was instituted for an offence under Section 379 of the Indian Penal Code. The stolen rice was sold to Vaishnavi Galla Bhandar. The petitioners happen to be employees in the said firm and due to that reason, his name transpired in the present case. Except for this, there is no other substantive evidence to suggest the implication of the petitioners in the present case.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 169 of 2019.
