The petitioner has prayed for bail in a case registered for the offence punishable under sections395 and 397 of the Indian Penal Code.

Prosecution case relates to committing dacoity by five accused persons after entering into informant's father house and tiding the hands and legs of his father .

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. On the basis of confessional statement of coaccused Sonu Paswan, his name has been surfaced in the present case. No TIP has been conducted by the police. Similarly situated other co-accused has already been enlarged on bail vide order dated 8.8.2022 passed in Cr. Misc. No. 21299 of 2022.

Patna High Court CR. MISC. No.44872 of 2022(4) dt.13-02-2023 2/2 Petitioner is languishing in judicial custody since 5.11.2021. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XXVI, Patna in connection with Gopalpur. P.S. Case No. 388 of 2021.
