The petitioner seeks bail in Charpokhri P.S. Case No. 72 of 2021, registered for the offence under Sections 304(B)/201/34 of the Indian Penal Code.

It is a case of dowry death and petitioner is father-inlaw of the deceased. It is submitted on behalf of petitioner that there is general and omnibus allegation. The thrust of the allegation is against husband of the deceased, who is already in custody. Petitioner lives separately and has nothing to do with the family affairs of the deceased. Petitioner is in custody since 07.07.2021.

Patna High Court CR. MISC. No.50401 of 2021(2) dt.24-01-2022 2/2 However, learned counsel for the informant opposed the bail petition and submitted that petitioner, being father-inlaw, has equally participated in the murder of deceased and disappearance of her dead-body.

Considering the rival submissions of the parties and the fact that thrust of the accusation is against husband of the deceased, who is already in custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bhojpur at Ara in connection with Charpokhri P.S. Case No. 72 of 2021 (G.R. No. 2168 of 2021).
