JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-12-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel appearing for the petitioner and Shri Arvind Kumar Pandey, learned A.P.P. for the State.

The present petition has been filed for modification of the order dated 13.12.2019 passed in Criminal Misc. No. 33661 of 2019 to the extent that the period granted to

Patna High Court CR. MISC. No.33467 of 2020(2) dt.23-12-2020 2/2 the petitioner for surrendering before the learned court below for the purposes of obtaining the privilege of anticipatory bail, be extended by a further period of four weeks from today. The learned counsel for the petitioner has submitted that on account of the pandemic situation due to COVID-19, the petitioner could not surrender before the learned court below within the stipulated time frame, hence the time granted to surrender, may be extended.

Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time period granted to the petitioner to surrender before the learned court of Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Complaint P.S. Case No. 481 of 2017, for the purposes of availing the privilege of anticipatory bail, by a further period of four weeks from today. Accordingly, the order dated 13.12.2019 passed in Criminal Misc. No. 33661 of 2019 stands modified. The petition stands allowed.
