2. The petitioner apprehends his arrest in connection with Mojahidpur P.S. Case No. 02 of 2026, registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109, 79, 303(2) and 61(2) of the B.N.S.
3. While the informant's children were returning to home, in the meanwhile, co-accused persons along with other unknown boys started teasing and when protest was made by the informant's son, they started abusing. On the next day of such incidence, all the FIR named accused persons, including the petitioner, came at the shop of the informant's nephew and started assaulting him. It is further alleged that when the son of
Patna High Court CR. MISC. No.41032 of 2026(2) dt.01-07-2026 2/3 the informant's came to his rescue, he was also assaulted by all of them and one 'Ritesh Vihari @ Nitesh Bihari' inflicted knife blow, besides there is allegation of snatching of valuables.

Learned Advocate for the petitioner taking this Court through the FIR contended that neither the petitioner was present at the time of teasing of the daughter of the informant nor there is any specific allegation of overt act or causing assault to the informant's nephew or his son. Only on account of the fact that the petitioner was also present at the place of occurrence, his name has been implicated in this case. The specific accusation is revolving around co-accused 'Ritesh Vihari @ Nitesh Bihari', who has allegedly inflicted knife blow. The petitioner, is a student and recently passed his intermediate examination, bears fair antecedent and he undertakes that he will fully co-operate in the proceeding of the Court.
5. On the other hand, learned Advocate for the State opposed the pre-arrest bail application and submits that the petitioner has actively participated in the crime.
6. Regard being had to the submissions made on behalf of the parties and considering the omnibus nature of allegation, coupled with the fact that the petitioner is a student, having fair antecedent, let the petitioner above named be

No.41032 of 2026(2) dt.01-07-2026 3/3 released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur P.S. Case No. 02 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
