2. The petitioner seeks bail in connection with Pirpainty P.S. Case No. 294/23 registered for the offence punishable under Sections 366/363/365/342/343/307/376D of the Indian Penal Code.

3. The victim after being raped by the petitioner and other co-accused Sunil Yadav was found unconscious at the place of occurrence. The victim in her statement before the police as well as the learned Magistrate has said that the petitioner and Sunil Yadav had raped the petitioner. The bail application of co-accused Sunil Yadav has also been rejected by this Court vide order dated 16.04.2024 passed in Cr. Misc. No. 7670 of 2024. The petitioner is in custody since 25.08.2023.

4. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

5. Considering the fact that the victim has been raped by two persons including the petitioner, this application for grant of bail is dismissed.
