In this case, the petitioners are apprehending their arrest in connection with Chautarwa (Bathwariya) P.S. Case No. 57 of 2019 registered for offences under sections 323, 366(A), 120B of the Indian Penal Code.

In the present case, the Informant has lodged the F.I.R. of kidnapping of her daughter for the purpose of marriage. The police has rescued the girl. In the statement

Patna High Court CR. MISC. No.39224 of 2019(2) dt.27-06-2019 2/2 made under Section 164 of the Cr.P.C., the victim girl has not attributed any allegation against the present petitioners rather she has stated that she had gone to the house of her uncle (Mausa) on her own volition.

Looking to the statement made under Section 164 Cr.P.C., let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bagaha, West Champaran in connection with Chautarwa (Bathwariya) P.S. Case No. 57 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
