JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2020 Heard Mr. Rajeev Ranjan, learned Advocate for the petitioner and the learned APP for the State. The petitioner, who is in custody since 04.02.2020, seeks bail in connection with S.K. Puri P.S. Case No. 466 of 2019, dated 31.12.2019, instituted for the offences under Sections 307 and 324 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is said to have fired at the informant while he was eating sweets only because both of them had dashed against each other.

Though the petitioner is the author of the injury on

No.33515 of 2020(2) dt.16-12-2020 2/2 the person of the informant, but considering the period of his custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 12th Addl. Chief Judicial Magistrate, Patna in connection with S.K. Puri P.S. Case No. 466 of 2019.

However, it is made clear that if the case goes to trial, the petitioner would participate in the same and his unauthorized absence from the trial proceedings, would render his bail liable to be cancelled.
