The petitioner apprehends his arrest in Aurangabad (Town) P.S. Case No. 215/2016, registered for the offences punishable under Section 406 of the Indian Penal Code and Section 138 of Negotiable Instruments Act.
The informant alleged that petitioner took loan of Rs. 3,01,500/- and gave three cheques, as security and the cheques were presented in the bank, but were dishonoured. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. The petitioner gave blank cheque to the informant in order to get the license of Shree Cement Factory, in which the informant was working. The
Patna High Court Cr.Misc. No.49916 of 2016 (2) dt.22-12-2016 2/2 informant made payment of construction materials purchased from the shop of the petitioner.
Considering the facts aforesaid and the fact that petitioner disputed the fact that he took loan from the informant and he handed over cheque to the informant for getting license of Shree Cement Factory, where the informant was working, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of I/c Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 215/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
