JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Sri Bimal Kumar, the learned advocate for the petitioner, and learned A.P.P. for the State. The petitioner is seeking bail in Barari P.S. Case No. 80/2017 dated 03.04.2017 registered under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

The allegations against the petitioner, as contained in the F.I.R., would show that she was apprehended by the patrolling party and 71 litres of country-made Mahua wine was recovered from her possession.

Learned counsel for the petitioner would submit that the petitioner is a lady having no criminal antecedents, as stated in Para 3 of the application, and that she has been falsely implicated

The learned A.P.P. opposed the prayer for bail, however, considering the fact that the petitioner is a lady having clean antecedent and that she is in custody since 04.04.2017, let the petitioner, namely, Sunita Devi @ Chanchala Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cum-Special Judge, Katihar in connection with Barari P.S. Case No. 80 of 2017.
