Petitioner is languishing in custody in connection with Muffasil P.S. Case No. 427 of 2015 for the offences punishable under Section 120B of the Indian Penal Code, Sections 25(1-A)/25(1-B)/25(1-AA) of the Arms Act and Section 17 of the C.L.A. Act.
Allegation against the petitioner is that the petitioner was running arms manufacturing factory. The report of the learned Court-below reveals that case is running for prosecution evidence. Petitioner is in custody since 18.12.2015. Considering the allegation, I am not inclined to enlarge the petitioner on bail. The bail prayer of the petitioner is
Patna High Court Cr.Misc. No.43679 of 2016 (4) dt.18-01-2017 2/2 refused. The learned Court-below is directed to expedite the trial and conclude the same preferably within six months from today without giving any unnecessary adjournment. If the trial is not concluded within the aforesaid period, the petitioner may renew his prayer for bail before the Court-below.
Let Senior Superintendent of Police, Gaya, be informed to ensure production of prosecution witnesses, who are mostly from the police department.
