JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 24-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Parbatta P.S. Case No. 105 of 2018 registered under Sections 457, 380 and 511 of the Indian Penal Code.

Petitioner is said to have made an abortive bid to commit theft in the house of the informant and he was apprehended.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. As a matter of fact, the petitioner happens to be neighbour of the informant and there is animosity between them. But on the call of the informant, he had gone to the house of the informant and was brutally

Patna High Court Cr.Misc. No.29087 of 2018 (3) dt.24-05-2018 2/2 assaulted by him and in order to save his skin, the informant has filed this false and frivolous case against the petitioner. Petitioner has also lodged F.I.R. regarding the aforesaid assault made to him at the hand of the informant. He has no criminal antecedent. He has been languishing in custody since 29.03.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 105 of 2018.
