JUSTICE RAKESH KUMAR ORAL ORDER 20-12-2016 Heard Sri Sunil Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Special Case no.13 of 2016(arising out of C-70(7) of 2016 registered for the offence under Section 20(b) of N.D.P.S. Act, has prayed for grant of bail.

By way of referring to paragraph-3 of the petition, it was submitted by learned counsel for the petitioner that the petitioner is having clean antecedent. He further submits that on false allegation of recovery of 225 of Ganja, which is much lesser than the smaller quantity of Ganja and he is in custody since 09.08.2016.

Considering the clean antecedent of the petitioner,

Patna High Court Cr.Misc. No.48251 of 2016 (2) dt.20-12-2016 2/2 period of custody as well as quantity of recovered Ganja, let the petitioner, namely, Mukesh Kumar Rajak be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum- Special Judge, Madhepura in connection with C-70(7) of 2016 ( Bihariganj Special Case no.13/2016).
