Petitioner is accused in connection with S. Tr. No. 214 of 2016 arising out of Saharsa Rail P.S. Case No. 09 of 2016 registered under Sections 328, 307, 379 and 34 of the I.P.C. The petitioner is in custody since 18.05.2016. The F.I.R. is against two unknown persons on the basis of C.D.R. of mobile No. 917563061293 and it was found that the SIM was of co-accused Sunil Kumar Sah. He disclosed that, in fact, the mobile was being used by the petitioner, who is uncle of Sunil Kumar Sah.

Submission of learned counsel for the petitioner is that co-accused Manoj Sah has already been granted Regular Bail

Patna High Court Cr.Misc. No.42121 of 2016 (4) dt.13-12-2016 2/2 by a Co-ordinate Bench of this Court vide Cr. Misc. No. 39924 of 2016 on 02.12.2016.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Sessions Judge, Khagaria in connection with Sessions Trial No. 214 of 2016 arising out of Saharsa Rai P.S.
