This application is for grant of anticipatory bail in connection with Akbarpur P.S.Case No.26 of 2015 for the offence under Sections 461, 380, 411 of the Indian Penal Code. It is submitted on behalf of the petitioner that the petitoner is not named in the FIR, however, later on Sanjay Rajbanshi was arrested and he in his confessional statement named one Karu Chaudhary and Karu Chaudahry in his confessional statement, named the petitioner but the petitioner has no criminal antecent and co-accused Karu Chaudhary and Sanjay Rajbanshi have been released on bail by the learned court below. Heard learned A.P.P. also.

Having heard both sides. In view of the statement as

Patna High Court Cr.Misc. No.459 of 2017 (2) dt.17-01-2017 advanced by the learned counsel for the petitioner that on the basis of confessional statement of the co-accused, the name of the petitioner transpires and there is nothing against the petitioner, let the petitioner, above named, surrender before the court below and make prayer for regular bail which will be considered by the learned court below on its own merit specifically considering the statement of the co-accused as well as considering the fact that the petitioner has no criminal antecedent, will pass appropriate order without being prejudiced by the order of this Court on the same day.

With the aforesaid observation, this application is disposed of.
