The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 323, 307, 302, 498(A) of the Indian Penal Code.

Prosecution allegation, in short, is that due to matrimonial dispute, in-laws family members of the sister of the informant assaulted the brother of the informant due to which he sustained injury and later died in course of treatment. It has been submitted on behalf of the petitioners that the petitioners are in custody since 2.9.2018 and have got no criminal antecedent. There is no allegation of tampering of

Patna High Court CR. MISC. No.38369 of 2019(2) dt.01-07-2019 2/2 witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. General and omnibus allegation has been made against the petitioners. No specific injury is attributed against the petitioners. Other co-accused has been granted bail vide order dated 7.3.2017 passed in Cr. Misc. No. 52333 of 2016.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Bhagalpur in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 196/15.
