JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 47 (a) of the Bihar Excise Act. About 350 liters of country made liquor was recovered from a poultry farm of co-accused Shailendra Singh and the name of this petitioner has transpired in the confessional statement of co-accused Shailendra Singh.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner and the petitioner was not present at the place of occurrence. He is in custody since 29.03.2017.

Considering the aforesaid facts as well as the period of incarceration, let petitioner, above named, be enlarged on bail
