Allegation against the petitioner is about recovery of one country-made pistol and eight cartridges from the possession of the petitioner, however his prayer for bail was rejected, vide order dated 12.9.2017 passed in Cr. Misc. No.42360 of 2017 with a direction to the learned trial court to expedite the trial and try to conclude it within a period of six months Submission of the learned counsel for the petitioner is that more than one year time has elapsed and there is no substantive progress in the trial.

Heard learned A.P.P. also.

Having heard both sides and in such view of the matter, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with

Patna High Court Cr.Misc. No.42726 of 2018 (5) dt.31-10-2018 2/2 two sureties of the like amount each to the satisfaction of the learned SDJM, Jehanabad in connection with Ghosi P.S.Case No.367 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
