The petitioner is languishing in custody in a case registered for the offences punishable under Sections 363, 365 of the Indian Penal Code.
It is alleged by the informant that minor daughter of the informant was kidnapped by unknown. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and his name subsequently sprang up during the course of investigation. The petitioner and the victim
Patna High Court CR. MISC. No.44313 of 2023(3) dt.23-08-2023 2/2 girl were in love with each other and they got married and out of the wedlock, there is a male child. As per medical report, the victim was found aged about 18-19 years. The petitioner is languishing in custody since 26.02.2023.
Learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 341 of 2020.
