The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 471, 379/411 and 120B of the Indian Penal Code. On secret information that the miscreants gathered near the Central Bank, Jadopur road to withdraw money from the ATM with fake ATM cards, raid was led, when one Ravi Shankar was apprehended, from whom large number of ATM cards of different persons, cash of Rs.78,000/-, PAN Card, cheque books, two mobiles and motorcycle were recovered, who disclosed the name of the petitioner. Patna High Court Cr.Misc. No.46714 of 2014 (02) dt.24-04-2015 2/2 petitioner that nothing has been recovered from the petitioner. Though, the petitioner is accused in two other cases of similar nature. It is further submitted that co-accused Upendra Giri, whose name was also suggested by the apprehended accused Ravi Shankar, has been granted anticipatory bail vide Cr. Misc. No. 8303 of 2014.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gopalganj Town P.S. Case No. 37 of 2014 pending in the court of learned Chief Judicial Magistrate, Gopalganj.
With the aforesaid observation, this application is disposed of.
