JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,379,506/34 of the Indian Penal Code and 3(1) (x) of the SC/ST Act. It is alleged that when the informant came to the shop of the petitioners and demanded Rs. 360/-, cost of 3 k.g fish which the petitioner Sanjay Yadav purchased from the informant and asked him to take price from his shop, all the petitioners abused him by taking caste name and also assaulted and snatched Rs. 1900/-.
It is submitted by the learned counsel for the petitioners that the accusation is general and omnibus in nature and the occurrence took place on 12.01.2014 and FIR was lodged on
Patna High Court Cr.Misc. No.34440 of 2015 (2) dt.17-08-2015 2/2 25.02.2014.
Considering the aforementioned facts, let the petitioners, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul SC/ST Case No. 06 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
