Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366A, 341, 323, 504, 506 and 120B of the Indian Penal Code.

Informant alleges that the petitioner with the help of his friend Rahul Kumar enticed away his 13 years old daughter Payal Kumari and when he went to his house in search, the petitioner and other accused persons abused and assaulted him. Learned counsel for the petitioner, referring to section 164 Cr.P.C. statement of the victim (Annexure 2), submits that the girl has herself stated that she is in love with the petitioner and has solemnized marriage with him in the temple at her own volition and she wants to go to his house. Petitioner has got no criminal antecedent.

No.38790 of 2019(4) dt.09-09-2019 2/2 Considering the facts of the case, let the petitioner, above named, in the event of his arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in K. Nagar Police Station Case No. 46 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
