JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-06-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Barh P.S. Case No. 15 of 2019 registered for the offence punishable under Sections 25(1-b)A/26 of the Arms Act. The petitioner is in custody since 12.03.2019. He had earlier approached this Court for grant of regular bail, which was rejected by an order dated 04.12.2019 passed in Cr. Misc. No. 48592 of 2019 with an observation that the petitioner shall be at liberty to renew his prayer for bail after he completed one year in custody in connection with this case, if the trial in the meanwhile was not concluded.
Learned counsel appearing on behalf of the petitioner has submitted that as a matter of fact the petitioner
Patna High Court CR. MISC. No.39421 of 2020(2) dt.30-06-2021 2/2 has remained in custody for more than two years and in other cases in which he has been made accused he has been enlarged on bail.
Considering the above submission and the observation made in the aforesaid order dated 04.12.2019, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, in Barh P.S. Case No. 15 of 2019. (Chakradhari Sharan Singh, J) Pawan/- U T
