The petitioners seek bail in connection with Mansi P.S. Case No. 240 of 2020, dated 25.08.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

From the prosecution report, it appears that 144 litres of liquor was recovered from a three-wheeler. The

Patna High Court CR. MISC. No.37705 of 2020(2) dt.05-02-2021 2/2 petitioners were only passengers in the aforesaid vehicle without any knowledge that the seized liquor was being carried in a jute bag.

The petitioner are in custody since 26.08.2020. Regard being had to the nature of accusation against the petitioners and the period of their custody, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Khagaria in connection with Mansi P.S. Case No. 240 of 2020. The application stands allowed.
