1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Section 366(A) of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and are women.
4. The informant alleges that on 01.04.2023 his sister had gone for tuition but did not return and during course of search he came to know that Yogendra Paswan has enticed her and taken away. It is further alleged that his sister and Bhabhi have hidden her in the house.
5. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.41189 of 2023(2) dt.04-08-2023 2/3 petitioners have been falsely implicated in the present case. It is further submitted that the victim and Yogendra Paswan were in love and they eloped. It is next submitted that they have married also and the petitioners being related to Yogendra Paswan came to be implicated with allegation that they have concealed the victim in the house. It is also submitted that had the petitioners concealed the victim in the house then definitely the victim would have been recovered but only to create pressure and coerce Yogendra Paswan into submission his sister and sister-inlaw have been implicated. It is further submitted that petitioner no. 2, who is sister of Yogendra Paswan, is married and stays at Nalanda.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
7. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kawakole P.S. Case
