Cognizance for an offence punishable under Sections 147, 148, 149, 341, 323, 447, 504, 506 IPC and 3 (1) (X) SC/ST (PA) Act had been taken on the basis of an allegation levelled by the informant, Tudho Devi on 13.06.2015 stating therein that on account of crossing through the land belonging to the accused by her son, an altercation took place followed with scuffle and during course thereof, on call of Motu Lal Ganesh, other co-accused including petitioners came armed variously, assaulted son of the informant, her husband including she herself. Furthermore, Rs.
Patna High Court Cr.Misc. No.39894 of 2016 (2) dt.17-09-2016 5000/- from pocket of her husband as well as one Hasuli was also snatched away.
Petitioners are under custody since 24.08.2016. Accordingly, petitioners, namely, 1. Kailu Ganesh @ Kailu Kumar, 2. Kudus Ganesh @ Kudus Kumar Ganesh, 3. Dilip Ganesh and 4. Laxman @ Checharu @ Checharu Ganesh are directed to be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge, SC/ST Act, Kishanganj in connection with (SC/ST) No. 47/2016 arising out of Dighalbank PS Case No. 81/2015 (G.R. No. 1010/2015).
