The petitioner seeks regular bail in connection with Rajapakar P.S. Case No. 136 of 2018, registered for the offence punishable under Sections 399, 402, 307, 120(B), 414/34 of the Indian Penal Code and Sections 25(1-B)A, 2/35 of the Arms Act.

The case of the prosecution is that upon secret information having been received by the police regarding unknown miscreants hatching a plan to commit robbery / theft, raid was conducted and the accused persons were arrested and as far as the petitioner is concerned, one country made pistol with four live cartridges was recovered.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.39434 of 2019(4) dt.17-08-2019 2/2 that the petitioner is having a clean antecedent and the chargesheet has already been submitted in the present case, hence, no prejudice would be caused in case the petitioner is granted bail. It is further submitted that similarly situated co-accused persons have already been granted bail vide orders dated 16.4.2019 and 21.6.2019 passed in Criminal Miscellaneous Nos. 24503 of 2019 and 37820 of 2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VII, Vaishali Hajipur in connection with Rajapakar P.S. Case No. 136 of 2018. (Mohit Kumar Shah, J) ajay gupta/- U T
