The petitioner is apprehending his arrest in connection with Benipatti P.S. Case No. 56 of 2012 registered for the offences punishable under Sections 323, 324, 504 of the Indian Penal Code and Section 3(X) of SC/ST Act.
Having perused the contents of the complaint petition it, is clear that occurrence took place on a road in a public view. Hence, I am not inclined to grant privilege of anticipatory bail to the petitioner and it is, accordingly, dismissed. However, Except Section 3(i)(x) of SC/ST Act, all other Sections of Indian Penal Code are bailable as submitted by the learned counsel for the petitioner.
However, if the petitioner surrenders in the court
Patna High Court Cr.Misc. No.30473 of 2015 (2) dt.11-08-2015 2/2 below within a period of three weeks and seeks regular bail, his regular bail application shall be considered on its own merit without being prejudiced by this order on the date of surrender itself.
