At the time of hearing of this writ application the learned counsel for the petitioner submitted that the application may be heard treating the application as an application under Article 227 of the Constitution of India. Accordingly, I heard her. It appears that the prayer has been made by the petitioner for a direction upon the court below i.e. A.D.J.-X-cum-Motor Vehicle Claim Tribunal, Patna to dispose of Claim Case No.144 of 2001 within a period that may be fixed by the High Court. In view of the decision of the Hon'ble Supreme Court in the case of Radhey Shyam & Anr vs. Chhabi Nath & Ors (2015) 5 SCC 423 the relief sought for in this writ application cannot be granted in exercise of supervisory jurisdiction under Article 227 of
Patna High Court CWJC No.9052 of 2015 (2) dt.22-04-2016 the Constitution of India. Thus, this writ application is dismissed. However, the petitioner may pursue the matter before the court below for expeditious disposal.
