JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-07-2015 Learned counsel for the petitioners seeks permission to withdraw the application with regard to petitioner no.1, Anita Devi since she wants to surrender.

Accordingly, the application with regard to petitioner no.1 is permitted to be withdrawn.

Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 323, 341, 324, 354 and 379 of the Indian Penal Code. It is alleged that the accused persons came variously armed, caught the hair log of the informant and pulled her down

Patna High Court Cr.Misc. No.29336 of 2015 (2) dt.29-07-2015 2/2 whereupon co-accused Suchen Yadav opened fire on her, Arbind Yadav stripped her and petitioner no.1, Anita Devi gave farsa blow on her head when other accused persons took away cash, jewellery and other articles It is submitted by learned counsel for the petitioners that for the petty dispute, the accusation has been levelled and the specific accusation is against Suchen, Arbind and petitioner no.1. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the fact that specific accusation is not against petitioner nos. 2 to 6, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Saharsa Sadar P.S. Case No. 227 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
