2. Learned counsel for the petitioner submits that the present application has been filed directing the respondent to send the Service Book of the petitioner to the office of Accountant General, Bihar, Patna, for grant of IIIrd MACP (P/B/3) Pay Grade 5400/- (Level-11). In this regard, counsel

Patna High Court CWJC No.10092 of 2024(2) dt.04-07-2024 2/2 submits that a representation has been filed before the District and Sessions Judge, Patna, but no order has been passed on the same.

3. Learned counsel for the State raised preliminary objection and submits that the said representation is defective. There is no receiving on those representation. He submits that the petitioner must file representation afresh.

4. Learned counsel for the Patna High Court and learned counsel for the Accountant General supported the argument of the State.

5. In this background, the writ petition is disposed off directing the petitioner to file fresh representation within thirty days before the District and Sessions Judge, Patna, who shall take a decision in this matter within 90 days from the date of receipt/production of a copy of this order along with representation.
