The petitioner apprehends arrest in Chainpur P.S. Case No. 69 of 2013 dated 19.05.2013 instituted under Sections 341/323/307/379 of the Indian Penal Code and 27 of The Arms Act, 1959.
Learned counsel for the petitioner submits that the allegation against the petitioner and another named coaccused as well as 7-8 unknown persons is that they had assaulted the informant and his wife and had taken away Rs. 20,000/- and mobile which is specific to the other named coaccused Rakesh Singh and not the petitioner. He has produced copy of the injury reports of the informant and his wife which shows only bruises with diffused swelling and the injuries have been opined to be simple in nature. Learned counsel submits that there is general and omnibus allegation
Patna High Court Cr.Misc. No.34925 of 2014 (5) dt.28-04-2015 2/2 of assault and the petitioner has clean antecedent. Learned A.P.P. does not dispute the position that there is general and omnibus allegation and the specific allegation of taking away of the mobile and Rs. 20,000/- is against co-accused Rakesh Singh and not the petitioner. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in Chainpur P.S. Case No.
69 of 2013, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds. (Ahsanuddin Amanullah, J.) P.
