JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 25.10.2016 passed in Cr. Misc. No. 46634 of 2016 giving liberty to the petitioner to renew his prayer for bail, if his trial is not concluded within four months. The learned trail court has reported that charge against the petitioner was framed on 18.11.2016 but up till now not a single prosecution witnesses could be examined.

Para-3 of the petition goes to show that petitioner has no criminal antecedent. Moreover, he is in jail custody since one year.

No.17248 of 2017 (3) dt.28-06-2017 2/2 Considering the detention of the petitioner in jail custody and present status of his trial, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Railway, Sonepur, Saran in connection with Chapra Rail P.S. Case No. 39 of 2016.
