This application has been filed for quashing of the order dated 23.06.2022 by which learned Chief Judicial Magistrate, Vaishali at Hajipur has taken cognizance against the petitioner in Mahnar P.S. Case No. 123/2022, G.R. No. 2352/2022 registered under Sections 379, 420 of the Indian Penal Code and Section 56 of the Bihar Minerals (Concession Prevention of illegal mining, Transportation and Storage) Rule, 2019 and further directed to deposit the loss amount caused due to mining of soil and fine amount of J.C.B. and deposit the receipt in the court below.

Learned counsel for the petitioner is permitted to deposit the demand draft of Rs. 4,00,000/- (Four Lakhs) before

Patna High Court CR. MISC. No.41186 of 2022(8) dt.09-05-2023 2/2 the District Mining Officer, Vaishali. After the same is deposited the JCB bearing Engine No. H00191013 and Chasis No. HAR3DXSSK 02604654 be released on showing the proof of deposit.
