JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-08-2021 Heard Mr. Mukesh Kumar Singh, the learned Advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Rajapakar P. S. Case No.85 of 2020, instituted for the offences under Section 302/ 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he is the brother of the father-in-law of the deceased. The deceased was married to one Amit Singh about ten years ago. There is no specific accusation against the petitioner. It has also been urged on behalf of the petitioner that he is an illiterate person and is physically challenged. In any case, the petitioner does not have any control over the affairs of the matrimonial family of the deceased.
Patna High Court CR. MISC. No.3907 of 2021(2) dt.04-08-2021 2/2 The offence under Section 302 of the I.P.C., so far as the petitioner is concerned, is not at all made out. The husband of the deceased is in custody.
Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Vaishali at Hajipur in connection with Rajapakar P. S. Case No.85 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
