Heard learned counsel for the petitioner no. 1 and the State.

Petitioner no.1 apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 342, 325, 307, 448, 379 of the IPC.

As per the prosecution case, FIR named accused persons including the petitioner no. 1 armed with weapons entered into the house of the informant and assaulted his father and took away cash and ornaments.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.40812 of 2022(2) dt.28-11-2022 2/2 that the petitioner is innocent and has falsely been implicated in this case. Allegation of assault is general and omnibus in nature. Both the sides sustained injury and there is no fire arm injury. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court of Sri, S.P. Mishra, learned Judicial Magistrate 1st class, Gaya, in connection with Aanti P.S. Case No. 08 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
