JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 24.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Pratapganj P.S. case no. 05/2015 registered under section 307 and other allied sections of the Indian Penal Code. Petitioners are said to have assaulted the informant with iron rod causing injury on the head. Injury report of the informant shows that the informant sustained two injuries: a sharp wound 2 1⁄2 " X 1⁄2" bone deep on scalp and one diffuse swelling 3" X 2" on left side of head. Injuries are simple in nature and said to be caused by sharp cutting weapon as well as hard and blunt substance. Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioners and accordingly, their prayer for

Patna High Court Cr.Misc. No.28501 of 2015 (2) dt.24-07-2015 anticipatory bail in connection with Pratapganj P.S. case no. 05/2015 pending in the court of Sri Kumar Rishikesh, Judicial Magistrate, Birpur (Supaul)/concerned court stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioners.
