2. The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioner who apprehends his arrest in connection with Janki Nagar P.S. Case No. 464 of 2024 for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 117(2), 324(4), 109, 74, 352 and 351(2) of the BNS Act, 2023.
3. As per the prosecution, FIR has been lodged against 11 named accused persons including the present petitioner against whom allegation to assault the informant's husband by sharp cutting weapon due to which injury has been caused.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that upon bare reading of the FIR, it transpires that there is absolutely nothing specific against the petitioner.
5. Counsel further submits that this matter has been placed before the Sessions Court and at the time of consideration of bail, case diary was also before him. Upon perusal of the case diary, it has been shown that petitioner has criminal antecedent, but there is no involvement of the petitioner in assaulting the victim. With the this direction, the sessions court has rejected the bail application of the petitioner and granted bail to some of the co-accused persons.
6. Counsel submits that the criminal antecedent of the petitioner is not clean as there is one criminal case pending against him in which he is on bail.
7. Learned APP for the State opposes the prayer for bail of the petitioner and submits that by virtue of specific allegation, the petitioner's name has inserted in this case. From the contents of FIR, it has come that the petitioner was not involved in killing the victim.
8. As such, in the present facts and circumstances of this case, let the above named petitioner be released on

No.39019 of 2025(2) dt.25-06-2025 3/3 anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of J.M.-1st Class, Purnea in connection with Janki Nagar P.S. Case No. 464 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
