JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioners are apprehending their arrest in connection with Sanokhar (Amdanda O.P.) P.S. Case No. 55 of 2015 for the offences instituted under Sections 341, 307, 504 and 323/34 of the IPC.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that on 21.05.2015, the informant was engaged in construction of his house at the same time the accused persons came and told to stop the construction works as they have their share in the land. In the

Patna High Court Cr.Misc. No.29792 of 2015 (2) dt.29-07-2015 2/2 meantime, accused Raj Kumar Thakur assaulted the informant on his head with Lathi due to which he got head injury and blood oozed out. On the intervention of the villagers the informant saves his life.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and counter case. The injuries are simple in nature. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Sanokhar (Amdanda O.P.) P.S. Case No. 55 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
