JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and informant claimed that he had seen the petitioner sitting under a tree along with some other persons in the night but the informant does not claim to have seen the actual killing of the deceased. However, in course o f investigation, the wife of the deceased was examined and she stated that one of the F.I.R named accused Pinki Kumari had illicit relation with the petitioner and 4 to 5 days prior to the alleged occurrence, petitioner and Pinki Kumari were caught in an objectionable condition on the basis of discloser made by the deceased and the aforesaid incident caused annoyance

Patna High Court Cr.Misc. No.37669 of 2016 (3) dt.10-11-2016 2/2 to the petitioner, who had been continuously giving threatening to the deceased.

Submission on behalf of the petitioner is that wife of the deceased disclosed that deceased had sweet relation with one Kiran Kumari @ Jyoti Kumari and the deceased might have been killed by relatives of the aforesaid Kiran Kumari. It is further submitted that except suspicion, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Chainpur P.S.Case No. 87 of 2016.
