Apprending his arrest in Complaint Case No.
1245/C/2016 registered under section 498-A IPC, the petitioner has filed the present application for grant of anticipatory bail. Learned counsel for the petitioner submits that on 14.03.2016 a divorce petition was filed whereafter the present complaint has been lodged. The petitioner is ready and willing to maintain his wife and even to take reasonable measures to resolve the matrimonial discord.
Counsel for the complainant, on the other hand, points
Patna High Court Cr.Misc. No.24671 of 2017 (4) dt.06-07-2017 2/2 out that meditation between the parties has failed. The petitioner is not willing to resolve the matrimonial discord. The counsel for the petitioner states that for securing the privilege of anticipatory bail, he would be ready and willing to pay a consolidated amount as directed by the court. Considering the facts and circumstances of the case, the petitioner named above, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SDJM, Patna in Complaint Case No. 1245/C/2016 on condition that one of the bailors shall be his own/close family member. Along with the bail bonds the petitioner shall produce evidence/receipt showing payment/deposit of Rs. 20,000/-( rupees twenty thousand) favouring the informant. It will also be open to the petitioner to produce a demand draft of the said amount favouring the complainant (wife) along with the bail bonds.
