JUSTICE SANJAY PRIYA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Civil Lines P.S. Case No. 353 of 2013 instituted for the offence under Sections 302/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he is in custody since 12.8.2013.
The status report was called for from the court below and the same has been received. The court below has stated in the report that out of 15 witnesses, 10 witnesses have been examined and the trial is likely to be concluded within six months. In such circumstances, since the trial is at the advance stage, this Court is not inclined to grant bail to the petitioner at this stage.
Patna High Court Cr.Misc. No.4980 of 2017 (4) dt.23-06-2017 2/2 Prayer for bail of the petitioner stands rejected. The court below is directed to conclude the trial within a period of six months and send compliance report to this Court. The petitioner is given liberty to renew his prayer for bail in the court below in the event the trial is not concluded within six months and the court below in that case will give reason in bail order for not concluding the trial within aforesaid period.
